These Terms of Use ("Terms") govern your use of the PME Charitable Group ("PME," "we," "us," or "our") website, registration pages, payment pages, and related online services. By using the site, creating an account, submitting a registration, or making a payment, you agree to these Terms and to our Privacy Policy.
2. Accounts and Information You Provide
When you create an account or submit information on behalf of yourself or others, you agree to:
- Provide accurate, current, and complete information
- Keep your contact details up to date
- Keep your login credentials confidential
- Notify us promptly if you suspect unauthorized access to your account
If you submit information about other people (such as team members, anglers, captains, or hotel occupants), you confirm that you have their permission to do so and that you have directed them to our Privacy Policy.
3. Authority to Act
By registering participants, submitting company information, or making payments, you confirm that:
- You are authorized to register yourself and any other people you include
- You are authorized to act on behalf of any company or organization you represent
- You are authorized to use the payment method you provide
4. Registrations and Event Items
Our site may allow you to register boats and teams, captains, anglers (including unassigned anglers), hotel occupants, sponsors, donations, and related items. A registration or order is generally considered complete only when:
- All required information has been provided, and
- Payment has been successfully processed.
PME may contact you to resolve missing or unclear information and may adjust registrations as reasonably needed to complete event administration.
5. Participant Information
You are responsible for providing correct and timely participant information, which may include:
- Names and contact details
- Dates of birth
- Passport details
- Fishing license information
- Shirt sizes
- Hotel and room occupant details
PME is not responsible for delays, denied licenses or travel, incorrect shirts or room assignments, or other consequences that result from inaccurate, incomplete, or late information.
6. Fees and Payments
We may charge fees for boat and team registrations, angler registrations, hotel-related charges, sponsorships, donations, merchandise, and event activities. Before you complete checkout, you will see a summary of the amounts and items.
By submitting payment, you authorize PME and our payment providers to charge the displayed total to your selected payment method. Payment processors handle sensitive payment details; PME does not store full card numbers.
7. Separate Transactions
Each completed checkout is treated as a separate transaction. If you later add participants, items, or services, those additions will normally create separate payment records and receipts.
8. Cancellations, Substitutions, and Refunds
Cancellations, substitutions, and refunds are governed by the specific policies shown at the time of registration. In general:
- Donations are nonrefundable.
- Sponsorships may become nonrefundable once benefits are provided.
- Hotel-related charges are subject to vendor deadlines.
- Substitutions require PME approval.
When a refund is approved, it will be issued to the original payment method, subject to bank processing rules.
9. Event Changes and Force Majeure
Events may be affected by factors such as weather, government restrictions, or participant levels. PME may change schedules or rules as needed. If an activity is canceled, PME will determine available credits or refunds after considering nonrefundable costs.
10. Rules, Conduct, and Compliance
By participating in PME events, you agree to follow tournament rules, boating and fishing laws, safety instructions, and licensing requirements. PME may limit participation for individuals whose conduct is unsafe or disruptive.
11. Travel, Documents, and Insurance
You are responsible for obtaining valid passports, visas, licenses, and insurance. PME does not guarantee entry into a country or specific transportation results.
12. Assumption of Risk
Fishing and outdoor activities involve inherent risks of injury or property damage. By participating, you accept these risks for yourself and any participants you register. Separate waivers may also apply.
13. Sponsorships, Donations, and Tax Matters
PME does not provide tax advice. The deductible portion of contributions may be limited by the value of goods received. Please consult a qualified tax professional for your situation.
14. Privacy
Our Privacy Policy explains our data practices. By using the site, you acknowledge that your information will be handled as described in our policy.
15. Third-Party Services
Our site relies on third-party services like Wix and payment processors. These providers have their own terms. PME is not responsible for the independent actions of these services.
16. Acceptable Use
You agree not to use the site for unlawful purposes, fraud, unauthorized access, or to disrupt the site's security.
17. Intellectual Property
All site content is owned by PME. You may use it for personal purposes only. Unauthorized reproduction is strictly prohibited.
18. Warranty Disclaimer
The site is provided "as is." PME disclaims all warranties to the fullest extent permitted by law.
19. Limitation of Liability
To the fullest extent permitted by law, PME Charitable Group and its officers, directors, employees, volunteers, sponsors, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the website, a registration, a payment, or participation in an event. Nothing in these Terms excludes liability that cannot legally be excluded. Additional releases or limitations may apply under a separately accepted participant agreement.
20. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless PME Charitable Group and its officers, directors, employees, volunteers, contractors, and agents from claims, losses, or expenses arising from information you submit, your unauthorized registration of another person or company, your violation of these Terms, your unlawful or unsafe conduct, or your infringement of another person's rights.
21. Governing Law and Venue
These Terms are governed by California law. Disputes will be settled in the county of PME's principal office.
22. Electronic Communications and Records
You consent to receive all transaction-related notices electronically.
23. Changes to These Terms
We update these Terms periodically. Changes appear on this page with a new Effective Date.
24. Severability and Entire Agreement
If a provision is invalid, it will be enforced to the maximum extent permitted. These Terms and our Privacy Policy form the full agreement.
